Title Insurance:
Title Insurance may be obtained at a cost of $270.00 which insures both the owner and the Mortgagee. Martin recommends purchasing Title Insurance as the costs associated with Execution Certificates may be lower and the costs of Water, Tax, Hydro, Fire, Building & Zoning and Work Order Certificates are usually eliminated because they are usually not required by the Mortgagee. As well, the cost of a new Survey, which may be required by the Mortgage company may be eliminated because many deficiencies which an up-to-date Survey might disclose would be covered under the policy, particularly setbacks for zoning purposes. Transaction Levy Surcharges would also not be required.


Land Transfer Tax:

Land Transfer Tax is payable to the Minister of Finance on registration of the Transfer. The Tax is calculated as follows:

Purchase Price (up to $55,000.00) x .005%
Purchase Price ($55,000.00 to $250,000.00) x 1% - $275.00
Purchase Price (Over $250,000.00) x 015% - $1,525.00
Purchase Price (Over $400,000.00) x .02% - $3,525.00

If you are in the process of refinancing property, you may expect your legal costs to be dependant on who the Lender as this will largely dictate the fees.
